Participant Consent, Release of Claims, Waiver of Liability, Assumption of Risk, and Indemnity Agreement

Old School Entertainment Venues: Ottumwa IA, Oskaloosa IA, Grimes IA, Rochester MN

In consideration of being permitted to participate in activities (“Activities”) within Old School Entertainment venues, including but not limited to axe throwing, arcade games, and other entertainment provided at these locations (the “Facilities”), I agree to the following terms:

1. Acknowledgment and Assumption of Risks
   I understand that participating in Activities involves inherent risks, including serious injury or death. I acknowledge that participation in axe throwing and other physical activities is subject to age restrictions and supervision requirements for safety and insurance compliance.
   • Participants ages 15 and older may participate in axe throwing and heavy-item throwing activities.
   • Participants ages 8–14 may only participate in “safe” throwing activities using lightweight or foam-based equipment (when available).
   • Children under 8 years old are not permitted to throw any objects.
   • Misuse of equipment, axe rebounding, or unsafe conduct may result in expulsion from the Facilities without refund.
   • Other risks include: falls, slips, equipment malfunction, projectile hazards, and negligence by other participants.
2. Physical and Mental Fitness
   I certify that I am in good health and have no conditions that would make participation in Activities unsafe. I agree not to participate under the influence of drugs, or any impairing substances. I agree to follow all safety rules and instructions provided by Old School Entertainment staff at all times.
3. Alcohol and Substance Use Policy
   I understand that Old School Entertainment venues may serve or permit the consumption of alcoholic beverages on the premises. I agree that:
   • Moderate and responsible consumption of alcohol is permitted; however, I agree not to participate in axe throwing or any other activity involving sharp, heavy, or potentially dangerous equipment if I am visibly impaired or unable to follow safety instructions.
   • I acknowledge that consumption of alcohol is entirely voluntary and at my own risk, and I accept full responsibility for my actions, decisions, and behavior while on the premises.
   • I understand that Old School Entertainment staff reserve the right to refuse participation, remove, or deny service to anyone suspected of being impaired, without refund.
   • I agree to comply with all venue policies and applicable state and local laws regarding the service and consumption of alcohol.
   • I release and hold harmless Old School Entertainment, its employees, owners, and affiliates from any claims, injuries, or damages resulting from the consumption of alcohol or other impairing substances by myself or others.
4. Release and Waiver of Liability
   On behalf of myself, my heirs, executors, and assigns, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Old School Entertainment, its employees, agents, participants, venue owners, equipment lessors, sponsors, advertisers, and others associated with the Facilities from any claims of injury, disability, death, or property damage that may arise from participation in the Activities. This waiver applies to claims resulting from the ordinary negligence of Old School Entertainment or its affiliates but does not waive liability for gross negligence or intentional misconduct.
5. Indemnification and Responsibility for Third-Party Claims
   I agree to indemnify, hold harmless, and defend Old School Entertainment, its affiliates, employees, agents, and venue owners from any claims, demands, or legal expenses, including reasonable attorney fees, arising from:
   • Any injury, damage, or loss due to my participation
   • Any third-party claims as a result of my conduct
6. COVID-19 Acknowledgment and Health Protocol Compliance
   I understand that participation in public activities includes potential exposure to COVID-19 and other health risks. I voluntarily assume all risks related to COVID-19 exposure and agree that Old School Entertainment venues, employees, and agents are not responsible for any resulting illness. I agree to follow all health protocols and guidelines in effect and acknowledge that failure to comply may void the protections of this waiver. This clause also applies to any future pandemics or health emergencies.
7. Participant Agreement to Safety Training
   I agree to participate in a safety briefing provided by Old School Entertainment, either in person or via video. By initialing here, I acknowledge that I have received, read, and understood the safety instructions and agree to abide by them. Failure to follow safety guidelines may result in expulsion from the Facilities without refund.
8. Consent for Media Use
   I consent to the use of photographs or videos taken of me at the Facilities for promotional and advertising purposes by Old School Entertainment. I grant Old School Entertainment full rights to copyright, use, and publish such materials in perpetuity without compensation.
9. Parental or Guardian Consent (For Participants Under 18)
   If the participant is a minor (under 18 years), the undersigned parent or guardian agrees on behalf of the minor (the “Minor”) to the following:
   • Acknowledgment of Risks: I understand and accept all risks on behalf of the Minor, including those that may lead to serious injury or death. I will explain these risks to the Minor and ensure they comply with safety guidelines.
   • Supervision and Age-Appropriate Participation: I understand that only participants aged 15 and older may engage in axe throwing or other heavy-weapon activities. Participants under 15 may only engage in age-appropriate, “safe” throwing activities (such as foam, plastic, or similarly approved items) under direct adult and staff supervision. I agree that I am responsible for ensuring the Minor remains within approved activity zones and follows all staff instructions.
   • Waiver of Liability for Minor: On behalf of the Minor, I hereby RELEASE, WAIVE, and COVENANT NOT TO SUE Old School Entertainment, its employees, agents, and venue owners for any claims arising from the Minor’s participation in Activities, to the extent permitted by law. I agree to indemnify and hold harmless Old School Entertainment for claims made by or on behalf of the Minor.
   • Assumption of Full Responsibility: I understand and agree that I, as the parent or legal guardian, am fully responsible for the Minor’s safety and conduct while on Old School Entertainment premises. If any injury, damage, or incident occurs involving the Minor, I accept full responsibility and agree that any resulting claims or actions shall be directed solely toward me as the parent or guardian, and not toward Old School Entertainment, its employees, agents, or venue owners.
10. Jurisdiction and Governing Law
    This agreement is governed by the laws of the state in which the specific venue of participation is located. Any disputes arising under this agreement shall first be resolved through mediation, followed by binding arbitration in that state, with costs covered by the initiating party.
11. Severability
    If any part of this agreement is deemed invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

Acknowledgment and Understanding:
I HAVE CAREFULLY READ AND UNDERSTOOD THIS RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT. BY SIGNING BELOW, I VOLUNTARILY AGREE TO ALL TERMS AND ACKNOWLEDGE THAT I AM WAIVING LEGAL RIGHTS THAT I MAY OTHERWISE HAVE.
